Overview of ERISA

We help fiduciaries navigate the increasingly changing and complex legal landscape while reducing exposure to fiduciary liability. ERISA (the federal law that governs retirement plans) requires prudent governance by plan sponsors and fiduciaries. The goal of our program is to assist in identifying potential weaknesses in a plan and provide remedies through different types of education, diligence, and a well-designed decision-making process.

9 Step Fiduciary Process

Our firm has a 9 point fiduciary process that repeats every few years. Our clients know exactly when we’re say, benchmarking the retirement plan or reviewing the plan’s internal controls. Maybe most important, our clients know that the plan committee has completed these action items.

Program Goals:

  • Identify plan fiduciaries and understand the extent of their specific responsibilities

  • Comply with ERISA Sections 404(a) and 404(c)

  • Ongoing due diligence calls will be available to explain our minutes and process.

  • Identify parties in interest to the plan and take steps to monitor transactions

  • Understand major exemptions under ERISA that permit transactions with parties in interest

  • Review plan documents in light of current plan operations and make necessary updates

  • Comply with reporting and disclosure requirements

After meeting with your Committee, we prepare a customized Executive Summary detailing results and action-items, providing valuable documentation required during plan audits and inquiries.
